Terms of Service

These Terms of Service (“Terms”) govern your use of the website at apotropaiclabs.com and any software application made available by Apotropaic Labs LLC (“Apotropaic Labs,” “we,” “us”), including the GreenGlass mobile app (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian.

2. The Service

The Service includes informational content on this website and the GreenGlass mobile application, which provides journaling tools for planted aquariums and an optional, community-curated species catalog. We may add, change, or remove features at any time.

3. Acceptable use

You agree not to:

• Use the Service to violate any applicable law or regulation, or to infringe the rights of any third party.
• Reverse engineer, decompile, or attempt to extract source code from the Service, except to the extent that this restriction is prohibited by applicable law.
• Probe, scan, or test the vulnerability of the Service or its underlying infrastructure, or interfere with its normal operation (including by submitting automated, abusive, or excessive traffic).
• Submit content that is unlawful, infringing, defamatory, harassing, or otherwise objectionable; that you do not have the right to submit; or that contains malware or other harmful code.
• Misrepresent the origin or authorship of any content you submit.

4. Your submissions

Some parts of the Service let you contribute content — for example, suggesting a species entry or a hero photo for the GreenGlass community catalog. By submitting content (“User Content”), you represent that you own it or have all rights necessary to grant the license below, and you grant Apotropaic Labs a worldwide, non-exclusive, royalty-free, sublicensable, perpetual license to host, store, reproduce, modify, display, distribute, and create derivative works of that User Content for the purpose of operating and improving the Service, including making approved User Content available to other users of the Service.

We may review, decline, edit, or remove User Content at our discretion. Information that you submit through these features is also covered by our Privacy Policy.

5. Intellectual property

The Service, including the Apotropaic Labs name, logo, and runic mark, the GreenGlass name, mark, and visual design, the website content, and all underlying software, is owned by Apotropaic Labs or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. No other rights are granted.

6. Third-party platforms

The GreenGlass app is distributed through the Apple App Store and the Google Play Store. Your use of the app on those platforms is also subject to the platforms’ terms. Apple Inc. and Google LLC are not parties to these Terms and have no responsibility for the app or for any claims you may have related to the app.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. INFORMATION IN THE GREENGLASS COMMUNITY CATALOG IS CONTRIBUTED BY USERS AND IS PROVIDED FOR GENERAL REFERENCE ONLY; YOU ARE RESPONSIBLE FOR THE CARE OF YOUR LIVESTOCK AND PLANTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APOTROPAIC LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

9. Indemnification

You will defend and indemnify Apotropaic Labs against any third-party claim arising out of your User Content, your breach of these Terms, or your misuse of the Service.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, including if we reasonably believe you have violated these Terms. Sections 4–9, 11, and 12 survive termination.

11. Changes

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may surface the change in the Service. Your continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
